An Act
to create
15.145 (6), 301.103 and 450.01 (16) (hr) of the statutes;
relating to:
creating a Corrections System Formulary Board in the Department of Corrections, therapeutic alternate drug selections in the state correctional system, and granting rule-making authority.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

15.145 (6) of the statutes is created to read:
15.145
(6)
Corrections system formulary board.
There is created in the department of corrections a corrections system formulary board. The board shall consist of the following members appointed to serve at the pleasure of the secretary of corrections:
(a) Two physicians, as defined in s. 448.01 (5), one of whom specializes in psychiatry.
(b) A pharmacist, as defined in s. 450.01 (15).
(c) Any other members appointed by the secretary in his or her discretion.

301.103 of the statutes is created to read:

Prescription drug formulary.
The corrections system formulary board shall promulgate rules establishing written guidelines or procedures for making therapeutic alternate drug selections for the purposes of s. 450.01 (16) (hr). Rules promulgated under this section shall apply uniformly within all state correctional institutions.

450.01 (16) (hr) of the statutes is created to read:

(hr) Making therapeutic alternate drug selections in accordance with written guidelines or procedures previously established in rules promulgated by the corrections system formulary board under s. 301.103, if the use of the therapeutic alternate drug selection has been approved for a prisoner, as defined in s. 301.01 (2), during his or her period of confinement in a state correctional institution, as defined in s. 301.01 (4), by any of the following:
1. A physician.
2. An advanced practice nurse prescriber.
3. A physician assistant.
