2015 WISCONSIN ACT

An Act
to amend
346.67 (1) (intro.) and 346.67 (1) (c); and
to create
346.67 (3) of the statutes;
relating to:
the duty to stop at the scene of a motor vehicle accident.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section
1

346.67 (1) (intro.) of the statutes is amended to read:
346.67
(1)
(intro.) The operator of
any
a
vehicle involved in an accident
resulting
shall reasonably investigate what was struck and if the operator knows or has reason to know that the accident resulted
in injury
to
or death of
any
a
person or in damage to a vehicle
which
that
is driven or attended by
any
a
person
, the operator
shall
immediately
stop
such
the
vehicle
at the scene of the
accident or
he or she is operating
as close
thereto
to the scene of the accident
as possible
but shall then forthwith return to
and
in every event shall
remain at the scene of the accident
until the operator has
fulfilled
done all of
the following
requirements
:

346.67 (1) (c) of the statutes is amended to read:
346.67
(1)
(c) The operator shall render
reasonable assistance
to any person injured in
such accident reasonable assistance
the accident
, including
the carrying
transporting
, or
the
making
of
arrangements
for the carrying, of such
to transport the
person to a physician, surgeon
,
or hospital for medical or surgical treatment if it is apparent that
such
medical or surgical
treatment is necessary or if
such carrying is
requested by the injured person.

346.67 (3) of the statutes is created to read:
346.67
(3)
A prosecutor is not required to allege or prove that an operator knew that he or she collided with a person or a vehicle driven or attended by a person in a prosecution under this section.

Initial applicability.
(1) This act first applies to violations committed on the effective date of this subsection.
