    2015 WISCONSIN ACT 245
    An Act to amend 60.75 (1) (a), 60.75 (2) (a) and 60.75 (2) (b); and to create 60.10 (2) (m) and 60.75 (2) (bm) of the statutes; relating to: authorizing a town meeting to direct a town board to change the number of commissioners of certain town sanitary district commissions.
    The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
    Section 1 . 60.10 (2) (m) of the statutes is created to read:
    60.10 (2) (m) Membership of town sanitary district commission. If the town board does not constitute itself as the town sanitary district commission, direct the town board to increase the membership of the town sanitary district commission under subch. IX from 3 members to 5 members, or direct the town board to decrease the membership of the town sanitary district commission from 5 members to 3 members, except that the town meeting may not act under this paragraph more frequently than every 2 years. If a town meeting directs the town board to decrease the membership of the town sanitary district commission, the reduction in members first applies upon the expiration of the terms of the first 2 commissioners whose terms expire at the same time after the town meeting directs the town board to reduce the number of commissioners.
    Section 2 . 60.75 (1) (a) of the statutes is amended to read:
    60.75 (1) (a) Except as provided in par. (b), the commission shall consist of 3 or 5 members.
    Section 3 . 60.75 (2) (a) of the statutes is amended to read:
    60.75 (2) (a) Except as provided in pars. (b) , (bm), and (c), commissioners shall serve for staggered 6-year terms.
    Section 4 . 60.75 (2) (b) of the statutes is amended to read:
    60.75 (2) (b) Except as provided under par. (c), of the commissioners in a district in which the town board changes the number of commissioners from 5 to 3 or of the commissioners first appointed or elected in a newly established town sanitary district , which consists of 3 members , one shall be appointed or elected for a term of 2 years, one for a term of 4 years and one for a term of 6 years. If the commissioners first elected in a newly established town sanitary district are elected at a special election, the town board shall specify shorter staggered terms for the commissioners so that their successors may be elected at a regular spring election.
    Section 5 . 60.75 (2) (bm) of the statutes is created to read:
    60.75 (2) (bm) Except as provided under par. (c), of the commissioners in a district in which the town board changes the number of commissioners from 3 to 5 or of the commissioners first appointed or elected in a newly established town sanitary district, which consists of 5 members, 2 shall be appointed or elected for a term of 2 years, 2 for a term of 4 years, and one for a term of 6 years. If the commissioners described in this paragraph are first elected at a special election, the town board shall specify shorter staggered terms for the commissioners so that their successors may be elected at a regular spring election.
